TheseTerms and Conditions form an agreement between a client booking a tour package and / or taking a tour (hereunder referred to as the Traveller, you or your)AND TravelLive (India) Private Limited (hereunder referred to as the Company, we, or us).

Upon signing the Booking Order and this document, these terms and conditions shall be binding on both the Company and the Traveller and shall become the only basis of relations between the parties and all previous communications in whatsoever form or mode, whether oral or otherwise, with respect to any term or conditions of the tour and services shall stand cancelled /revoked/terminated. We strongly advise that the Traveller retains a copy of these terms and conditions and a copy of the Booking Order for future reference.

Each of the below conditions shall be severable from the other and if any provision be invalid, illegal, or unenforceable, the remaining provisions shall nevertheless have full force and effect. No liability on the part of the Company arising in any way out of the Contract in respect of any tour, holiday, excursion facilities shall exceed the total amount paid or agreed to be paid for the tour holiday and shall in no case include any consequential loss or additional expense whatsoever.

All claims, disputes relating to the tours of the Company are subject Indian Law and subject to the jurisdiction of Kolkata Courts only.

1. BOOKING A TOUR

a) Please read carefully and understand the content of the Tour Brochure /Website Itinerary, the Terms and Conditions, Tour Cost and other such documents as may be applicable, as all these will form part of your agreement with us.

b) The Company requires you to sign the Booking Order with Estimate and provide certain documents described in Section 9 below and LRS (Liberalised Remittance Scheme, a part of the Foreign Exchange Management Act of India) at the time of booking a tour.

c) The Company advises you to ensure, before making a booking, that you have and / or you will be able to provide all the required valid and genuine documents along with your professional qualifications to enable you to apply for visa, insurance etc.

There is no Contract between the Company and the Traveller until we have received the Registration Fees described in Section 3.

e) In case of one or more but not all tour clients named in the Booking Order sign thisdocument, it shall be deemed that the signatories have been duly authorized by all such tour clients to sign on their behalf assuming full responsibility and accordingly it shall be deemed that all such tour clients have signed this agreement.

f) The full payment must be paid in accordance with prescribed payment schedule, failing which the Company reserves the right to cancel the booking with consequent forfeiture of booking amount and apply cancellation charges as mentioned in section 13 below.

2. ACCURACY DISCLAIMER OF TOUR ITINERARY IN OUR BROCHURE & WEBSITE

a) All the content in brochure and website have been built with the available information at the time of publication. We take utmost care in preparing the content. However, the Companyis not responsible for any printing or typing error.

b) As the brochure and tour itinerary may have been printed much earlier than your actual booking, the Company reserves the right to change any information in the brochure, website, and tour itinerary before/after your booking the tour.

c) The photos of meals, sightseeing and accommodations etc. are for reference only and may differ from the actual. Distance between places and temperatures are approximate and can change depending on travel mode, road conditions and climatic changes.

d) The prices given in Booking Order supersedes the indicative prices given in the brochure.

e) No person other than the company, in writing, has the authority to vary, add, amplify, or waive any stipulation, representation, term or condition in the brochure.

3. CHANGES IN THE TOUR ITINERARY

a) Please read the day-to-day itinerary carefully. The Company reserves the right to alter, amend, change, or modify the tour packages and itineraries before or during the tour. Changes may be necessitated due to factors beyond our control such as Force Majeure events, strikes, fairs, festivals, sport, events, weather conditions, traffic problems, overbooking of hotels / flights, cancellation / re-routing of flights, trains, or bus service, closure of / restricted entry at a place of sightseeing etc.

b) We will make reasonable efforts to notify you promptly of such changes / events well in advance during booking or prior to departure of the tour. If such changes / events occur during the tour, our tour professional or local representative will inform you of the changes and we solicit your full co-operation in accepting such circumstantial changes. Therefore, no grievances regarding any itinerary / service changes; which we are constrained to make; will be entertained from the tour clients during or after the tour.

c) The Company reserves the right to change / cancel the departure date due to unforeseen reasons. In such cases, the Company will make refunds as per section 9 of this document. The Company shall not be liable, at any time for any, direct, indirect, incidental, or consequential, damages (including any other services such as air tickets, any entry tickets, or add-on tours you may have booked).

d) You will have to follow the Tour Program and return to India as per the tour itinerary. There shall be no refund, if the Traveller fails to join the group at the beginning of the tour or joins the group later or leaves the group before the end of the tour. It shall be noted that for all purposes, it shall be the responsibility of the Traveller to reach the place at the beginning of the Tour and register with our representative at the designated place, date, and time.

e) In case if the Traveller along with his family is compelled to discontinue the tour due to any reason whatsoever including illness, death or loss of passport or any travel documents, no claim shall be entertained for refund of unutilized services.

f) If the Traveller avails pre-tour services or part thereof, or the air tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the air tickets or pre - tour arrangements or part thereof, it shall be treated as “no show” and there will be no refund for the unutilized pre-tour or main tour services.

g) Changes in itinerary may also be necessitated on account of actions, inactions, defaults, or condition of tour clients in the group.

h) The Company shall not be liable to refund any amount or pay any compensation / damages on account of any change in itinerary. In case the alternate arrangements made are materially superior as compared to the ones described in the Brochure, we may charge extra for the same at the time of booking or during the tour.

4. TOUR PRICES

All Domestic tours are priced at Indian Rupees. All International Tours are priced with an Indian Rupees component and one or more foreign currency components. The foreign currency is determined by the location(s) included in the tour and the local currencies in those countries. In some countries, where the local currencies are not stable, a neutral currency like US Dollar is used to price the tour.

a) The prices quoted for the Tour in the Booking Order have been calculated at the rate prevailing at the time of booking. The Company reserves the right to amend the prices published in this brochure in case of currency fluctuations, changes in the various gross rates of exchange, and/or fuel costs, special/high season charge levied by the suppliers, hike in the airline charges or surcharges before the date of departure. All such increases in price must be paid for in full before the Departure by the Traveller.

b) You are required to pay for the Tour in Indian Rupees. All foreign currency components of the price will be converted to Indian Rupees at the date of each payment separately.

c) Our Booking Order will show an estimated price which is derived by converting the foreign currency amount to Indian Rupees using the prevalent exchange rate. In case the exchange rate changes on the date of payment, the then prevalent rate will be charged.

d) At times, Travellive, at its sole discretion may avail of “Visa at your Doorstep” facility offered by the visa agent in order to get a timely appointment. If such facility is availed,any additional costs on top of our standard prices will be borne by the Traveller.

5. PAYMENT PROCEDURE

a) All payments towards the tour cost must be made by the client to the Company in accordance with the procedure and time frame mentioned herein below. Payments can be made by Cheque, Demand Draft, NEFT, RTGS or IMPS, UPI, or Credit Cards. Payments through Credit Cards may attract an additional surcharge covering the cost of the transaction that is charged by the bank.

b) Payments made towards the foreign exchange component of your tour will be calculated as per the rate of currency exchange on the day the payment is realised by us. The foreign exchange component of the tour cost is governed by the Liberalised Remittance Scheme (LRS) under Foreign Exchange Management Act of the Government of India. It is the sole responsibility of the Traveller to ensure that the payment is within the LRS Scheme. The Traveller will have to submit a declaration to that effect at the time of booking.

c) Payment will have to be made according to the payment schedule published in the Booking Order. The payments are generally broken down in three or four instalments.

  • Registration Fee at the time of booking. The RegistrationFee is INR50,000 (Rupees Fifty Thousand only) per Traveller but may be higher for some tours.
  • A second instalment of advance, applicable for high value tours, or tours that include cruises
  • Foreign Exchange amount to be paid before the visa appointment, or as specified in your Booking Order, whichever is earlier.
  • Final payment (balance of the tour cost) to be paid 45 days prior to departure date of the Tour, or as specified in your Booking Order, whichever is earlier.

d) GST and TCS will be added to the tour cost during each payment, and the Traveller will bear these.

e) In case the Traveller makes tour payment by cheque and such cheque is dishonoured / declined, a charge of Rs. 500 + 18% GST will be levied by the Company and borne by the Travellers immediately.

f) Full payment must be made in accordance with the procedure stated above. In case of non-compliance thereto by the client, the Company reserves the right to cancel the booking of the client with subsequent loss of deposit and recover the cancellation charges.

6. AIR TICKET BOOKING AND MODIFICATIONS

The Company may book airline tickets through a group booking or individual bookings as its sole discretion. Unless otherwise mentioned, we provide economy class tickets with a reasonable allowance for checked-in luggage. We clearly indicate when meals are provided on board.

a) All the booking / cancellation / change of the airline ticket and the travel on such airline ticket will be subject to the terms and conditions of respective Airlines.

b) In the event the airline decides not to allow a Traveller to board a flight, the Traveller shall not hold us responsible for the same and no claim whatsoever can be made by the Traveller to us. The Traveller will have to settle their claim directly with the airline. We will assist the Traveller with our best effort.

c) Every airline has their own set of baggage rules and regulations, and these allowances change from time to time. We will advise you on the details during our pre-departure briefing. You are requested to please check the updated baggage restrictions of the individual airlines. In case the airline levies extra charge for your excess baggage, you are solely responsible for the payment. Also, we are not liable for any loss or damage to baggage while it is in the custody of the airline.

d) It is possible you are booked on a group fare ticket; therefore, you are advised to report at the airport check-in counter at least 3 prior to the departure time, or as directed by the tour director.

e) Seat allocation is a matter of airlines discretion and availability of the same is not in the control of the Company. We shall not be held responsible if you do not get seats as per your preference.

f) At times the local airport authorities increase the airport taxes / airport development fee after tickets are booked. In such cases, we will notify you of such changes and you will have to bear the extra cost.

g) In case you are returning on a later date after the tour ends, you will have the responsibility / liability to re-confirm air tickets 72 hours prior to your departure.

h) You are responsible to carry your baggage. Any cost you incur towards this will have to be borne by you.

i) In any situation we are not liable to for loss of baggage by the airline, failure to provide meal of your choice by the airline, denied boarding despite having confirmed tickets, quality of meals offered by the airlines, flight delay, change in flight schedule/routing or you miss the flight etc.

7. ACCOMMODATION

a) We select hotels which are convenient and comfortable, to reduce travelling time and to maximise opportunities of sightseeing. Due to Environmental Protection Laws, various countries have regulations on how they will operate their air conditioning systems. All Travellers agree to abide by such laws of the land.

b) In the countries where the climate is temperate, the hotels may not have an air conditioning system. The Traveller agrees to stay as per the standard environment provided by the hotels.

c) The Traveller will have to abide by the check in /check out time of the hotel.

d) We cannot guarantee the availability of adjoining rooms / interconnecting rooms / smoking / non-smoking room etc.

e) We would recommend only 2 persons in one room for your own comfort. Triple rooms are usually no larger than twin rooms and the third bed is often a rollaway cot put in a twin room for the night.Travellers who book additional bed in the same room agree to live in such accommodation.

f) A double room has either a single queen-size bed or two separate beds. If you request for a room with a queen-size bed, the same would be provided subject to availability as most of the hotel rooms in Europe are twin-bedded. In-case of non-availability of a room with a queen-size bed, a twin-bedded room would be given.

g) The hotels will either be those shown in the itinerary or of the similar category. Due to heightened local demands in the cities, hotels may be booked out in advance. In view of this you may have to stay in hotels further away from the cities and itineraries may have to be altered/amended.

h) Facilities like mini bar, pay television channels, telephone etc. are not complimentary and these facilities, if availed by the Traveller, must be paid for by the directly to the Hotel and such charges are not included in the tour cost.

i) Any damages caused to the hotel rooms during your stay/tours/visit shall be borne and payable by you, and we will not be accountable for the same.

j) The Company is not accountable if there is sudden disruption/disorder of telephone, internet services, and other amenities while staying at the hotels. The Company will also be not responsible for the facilities provided or not provided in the room/bathroom/hotel premises etc. by the Hotel or its staff.

k) All baggage and personal effects are your sole responsibility. We will not be responsible or liable in case of loss of such items during the tour. Some hotels offer the facility of safe deposit lockers, which can be availed of by you at your own cost and risk.

8. COACH AND SEATING

a) We generally take air conditioned/air-cool coaches. At times due to weather extremity the air condition may not work or may not be effective. We are not responsible for any malfunction/defect in the coach.

b) The seating arrangements will be on rotation basis for which our tour director will have the final discretion.

c) The Company will not be responsible in any way for valuables left behind in the coaches.

d) The coach drivers are bound by local labour laws regarding maximum driving hours per day and per week and the itineraries are planned according to that. It is necessary that you should follow the timings/itineraries/schedules to make sure that all the services listed will be provided. If the tour gets curtailed on a day due to delays caused by one or more Travellers, the Company will bear no responsibility shall not be liable.

e) Smoking, consumption of alcoholic beverages and food itemsare strictly prohibited on coaches.

f) You are liable for any damage you cause to the coach or bring any harm to the coach driver.

g) Porterage is not included in the tour price. It is often difficult to get porters to assist as hotels may or may not provide this service and it is therefore advisable to use bags with wheels. You are advised to carry only one suitcase of a size of 158cms (width + length + height) preferably and one handbag per person in the coach. The suitcase should be with wheels for sake of convenience.

9. MEALS AND SPECIAL REQUESTS

a) Meals are pre-booked and pre-set, the type of meals are clearly indicated in the brochure, and it would not be possible to provide a special meal / diet / cuisine other than what is mentioned in the brochure. The Company reserves the right to change the meal arrangement if circumstances make it necessary to do so.

b) There would be no refund if the Traveller chooses not to take any meal. In the event the client misses any meal, including breakfast, offered to him by the Company, no claim can be made for the meal/breakfast, which Traveller has missed and not utilized.

c) If you have any special requirements on dietary considerations,please notify us in writing at the time of booking and we will try to meet your special requestssubject to availability. The Company cannot guarantee those special requirements will be met by the supplier and we accept no responsibility for such special request not being met.

10. CURRENCY AND TRAVELLERS' CURRENCY CARD

a) Travellers' Currency Card is a safe way to carry money as they are accepted as a mode of electronic payment in majority of the outlets and one card can work across multiple currencies. At the same time, you are advised to carry some amount of local currency for your daily needs. You may also use your Currency Card to withdraw cash from any VISA / VISA Plus ATM around the world.

b) Getting foreign currency of your choice is your sole responsibility. The Company may, at your request, assist you by connecting you with reliable forex trading companies. We are in no way involved in the forex dealing.

11. VISA, IMMIGRATION, AND DOCUMENTATION REQUIRED

It shall be the sole responsibility of the Traveller to hold valid travel documents and statutory clearances such as passports, visas, confirmed air tickets, and overseas medical insurance certificates and other certificates including immigration clearance etc.

a) Passport: For travelling abroad, all Travellers including children and infants must possess a machine-readable passport, valid for minimum of 180 days (in some countries it is for nine months) from their return travel date. Please ensure that the passports are well maintained and have sufficient blank pages that are serially numbered and not damaged, stapled or torn for recording stamping of visas of various countries.

  • If you are not able to partake the tour due to any deficiency in your passport, you will be liable to pay cancellation charges.
  • In case you decide to take visa assistance from the Company, we will collect and submit your passport(s) to various consulates or authorised private visa processing entities on your behalf. If the passport gets damaged during this process, the Company will not be liable to pay compensation/ refund / claim as the Company does not have control on these authorities.

b) Visa: A visa is a mandatory document that permits the Traveller to enter another country. For tourists, generally a short-term visa is granted by the respective consulate. Documents required for visa application vary country-wise. On your request, we provide Visa Assistance services.

  • You understand that the Company is just a facilitator for procuring visas; and the decision to grant Visa to any individual or family is at the sole discretion of the respective consulates.
  • Our Documentation Department shares a complete list of documents with the Traveller on their registered e-mail ID when we start the process of Visa Assistance. You have the sole responsibility of providing all documents required for successful application of a visa. Failure on your part to provide your personal documents at the right time may lead to a rejection of visa, or your visa sanction may get delayed, affecting your ability to take the tour. In all such cases, you will bear the responsibility, and the Company will not be liable. The company will apply cancellation charges as described in section 13.
  • The time taken to issue a visa varies considerably in different countries. Even within a country, the time taken may vary depending upon the present workload in the embassies or consulates. The Visa sections of these countries provide updates on processing time, and you are advised to check these updates. It is your responsibility to promptly furnish all documents required for application of visas when asked to do so. If any delay on your part to submit documents leads to a delay in getting visas, affecting your ability to take the tour, you bear the sole responsibility, and we will not be liable for refunds. In such cases, you will have to bear the cancellation charges.
  • The Consulate may call you for a personal interview even after all relevant documents have been submitted. You will bear the cost of such personal appearance, which may require an inter-city travel depending on the location of the interview.
  • In some cases, normal visa appointment may not be available in time for your tour. Travellive may arrange for a Visa at your Doorstep at its sole discretion. This will attract additional charges, which will be borne by the Traveller.
  • If you choose to take extra services with the visa agent at the time of your document submission, if you bear all expenses associated with those services.
  • You agree not to proceed legally against us for a rejection of visas unless there is a manifest error on our part.
  • We would not be responsible for any clerical error in issuing visa made by the concerned embassy or consulate. We request you to cross-check the visas copies and intimate us promptly about any discrepancies, if any.

c) Overseas Medical Insurance: All Travellers must purchase overseas medical insurance to cover their risks such as personal injury, medical expenses, death, repatriation expenses, evacuation expenses, etc. Cost of insurance premium included in the tour packageare described below:

  • The cost of Insurance premium for our standard insurance package is included in the tour price for all international tours up to the age of 70 years (except America& Canada, where the premium covers up to age of 60).
  • For the age group over and above the age limit, the Traveller needs to pay an additional amount to cover the difference.
  • Our Insurance Assistance is limited to Indian nationals.Foreign nationals will have to be obtain insurance on their own.
  • You will have a direct contractual relation with the insurance company, and our responsibility is limited to assisting you in buying the insurance. The insurance company shall be solely responsible for granting or rejecting claims, and you shall settle any dispute arising due to rejection of claim or adequacy of settlement amount directly with the Insurance Company. In an event of any claims, the Company is not responsible for any coordination with the Insurer.
  • If you decide to extend the tour for longer than our published schedule, you will have to procure additional insurance.
  • Adventure sports or activities that are included in your tour shall not be covered in the insurance policy and in case of any death, injury, or other loss due to your participation in such adventure sports will not be borne by the Company.
  • In case of death of any Traveller during the tour, all the arrangements of transportation of the corpse including procurement of the death certificate, post – mortem, repatriation of corpse and all personal effects, insurance claims, shall be borne by the Traveller accompanying the deceased or known acquaintances of the deceased. The Company or its tour directors shall not be able to extend any help for the same.
  • Travellers must carry a copy of insurance on tour and present such copy to the authorities when asked for. We cannot be held responsible if a Traveller is denied entry in a certain country because of absence of copy of such insurance.

d) Immigration Holding a valid visa only allows a Traveller to enter the respective country’s immigration point. Granting the permission to enter a particular country is sole prerogative of the immigration authority. Sometimes a Traveller may be deported/ interrogated/ and may be held back by the immigration authorities for a longer span than the usual time. In such a case, the Traveller missing out on the itinerary program is not the Company’s liability. All the Expenses incurred by Travellers while they are held back by the immigration authorities or deportation costs would be borne by the Traveller and the Company shall not be responsible for any reversals towards this. In such cases of deportation/ interrogation/ rejection of permission to enter a particular country by the immigration authorities, the Traveller is not eligible for any refunds and compensations from the Company.

12. AMENDMENTS / DEVIATIONS

a) If you wish to amend or change your booking, you must communicate your request to us in writing. Such requests for change or amendment will be accepted subject to availability. Please note that:

  • The altered or changed booking will be regarded as a new booking.
  • A cancellation charge shall apply as if a cancellation was made on the date the request for alteration.

b) If you wish to travel in advance i.e., before the published departure date as mentioned in the brochure or like to come back on a later date after the tour ends, there will be an additional charge as per the airline that will be applicable (subject to availability of seats for the given dates & ticket validity) which will be communicated to you. Kindly note, the deviation will be actioned only 30 days prior to departure date.

13. CANCELLATION

a) Cancellation of the entire tour by the Company:

Every tour requires a minimum number of passengers to operate. If minimum numbers are not achieved,the tour may be cancelled by the Company on short notice. In such cases, we will offer you alternative tour dates /tours or you would have the option of travelling as individual travellers, not as part of the original tours. If the alternative date / tour is not acceptable or you do not wish to travel as individual travellers, we would refund the money paid by you without interest after deducting any costs incurred by us on your behalf, within a period of thirty days from the date of cancellation.

b) Cancellation of booking(s) by the Company with cause:

The Companyreserves the right cancel booking(s) of a Traveller or a group of Travellers in case these Travellers violate the Terms and Conditions of the booking, or default on some parts, such as delay in payments, failure to get visa, failure of get insurance, or No Show.In such cases, the Company will make refunds as per section 14 of this document. The Company shall not be liable, at any time for any, direct, indirect, incidental, or consequential, damages (including any other services such as air tickets, any entry tickets, or add-on tours you may have booked).

c) Cancellation by the Traveller:

If you wish to cancel your booking, you must inform us in writing. Such notification shall be deemed to have been given to us only on the date of the receipt ofyour letter, since we can act only on receipt.

d) The following cancellation charges shall apply irrespective of the reason forcancellation. You understand and acknowledge that these charges are agenuine pre-estimate of the damages that we will suffer on account of cancellation. You understand that these damages are called liquidated damages in legallanguage, which are payable without proof of actual damages. You agree notto dispute such deductions or to demand proof of actual damages.The Company is entitled to charge the following cancellation fees to the Travellers.

For trips excluding cruises
Before Visa application:Rs.10,000/- + ticket cancellation charges (if applicable)

A 'No Show' on the tour:100% of the Package Cost

44 days or less prior to departure:100% of the package Cost
A 'No Show' on the tour:100% of the Package Cost

e) In case of visa delay or refusal leading to your inability to partake the tour, you would be deemed to have cancelled on thedate of intimation of such rejection. Please see our Visa Guidance section forfurther details

f) In case of delay or refusal of visa resulting in cancellation / deviation of tour immediately before original departure date, cancellation / re-booking charges must be borne by the Traveller.

g) If you fail to pay the tour costs on time or if you commit any other default inrelation to your booking, the Company reserves the right to cancel your booking with cause. In such cases, the cancellation charges shall be computedwith reference to the date on which we issue you a notice of cancellation.

h) If on your failure of payment or other default, no notice of cancellation isissued by us, but your payment or default remains outstanding on the date ofdeparture, the booking shall be deemed to have been cancelled by you withoutany advance notice, inviting the highest cancellation charge. You expresslyagree to abide by the foregoing terms and conditions.

14. REFUNDS, CLAIMS & COMPLAINTS

a) Refunds (if any) for Changes and / or cancellations will be paid directly to you for bookings made directly with the company's office.For bookings routed throughyour Travel Agent, the refunds will be routed through them.

b) There is no refund payable for any unutilized or partially utilized services (e.g.,Airline tickets, Meals, Entrance Fees, Optional Tour, Hotel, Sightseeing etc.)

c) Third Party refundssuch as airlines, cruise, overseas suppliers could take between 30 to 140 working days depending upon the processing time of the agency.Depending on your situation, the agency may ask for documents supporting the reason for your refund request. You will be solely responsible to provide relevant supportingdocuments.

d) Any claim or complaint by the Traveller must be notified to the Company in writing within 16 days from end of the holiday tour. Claim notified to the Company beyond this period will not be entertained and the Company shall incur no liability in respect thereof. Also, the claim should be substantiated with proper evidence and deficiency of services provided should be countersigned by the tour manager / local representative.

e) The refund of the foreign exchange component of the tour will be paid back in INR only and will be at the rate of exchanges of the company on refund date.

15. SOME OTHER CONDITIONS FOR TRAVEL

a) Each of these conditions shall be severable from the other and if anyprovision be invalid, illegal, or unenforceable, the remaining provisions shallnevertheless have full force and effect. No liability on the part of the Companyarising in any way out of the Contract in respect of any tour, holiday, excursionfacilities shall exceed the total amount paid or agreed to be paid for the tourholiday and shall in no case include any consequential loss or additional expensewhatsoever.

b) As you are traveling with a group of other travellers on vacations, you are expected to conduct yourself in a manner that is not offensive to others or disruptive to the group. For the benefit of everyone on your vacation, the Company reserves the right to accept or reject any Traveller and to remove any Traveller whose conduct is deemed incompatible with the interest of the other participants. In suchtermination cases, we will neither refund nor cover any cost or expenses you incur.

c) The Company shall in no circumstances whatsoever be liable to theTraveller for:

  • Any overstay expenses due to delay or changes in bus/ air/ trains / ship/ orcancellation of special bogie or other services due to sickness, weatherconditions, strike, war, or any other cause whatsoever.
  • Sightseeing missed & / or program being cancelled after the commencementof the tour & before the due period due to any unavoidable situations which arebeyond our control.

d) Initial deposit ensures only registration/participation on the tour butdoes not entitle any services like Tickets, Visas, and Hotel Accommodation until fullpayment has been received.

e) We cannot endow with individual aid to any of the tour member for walking, dining, getting on & off from any of the transport vehicle or otherpersonal needs. So, it is indispensable that a qualified companion must accompany such Traveller who needs such assistance. In the absence thereof, such Travellerwill be joining the tour on his own risk and consequences.

f) The Company solely reserves the right to publish group photographs of thepassengers taken during the tour.

g) The tour will be operated by a tour manager of the Companysubject to a minimum of 20 full paying passengerstraveling together. In case the above requirement is not met,our local representative will be there to assist the Traveller. When the tour has less than 15 adults and is operated on seat-in-coach basis,there will be instances where the drivers act as a guide.

16. REQUIREMENTS DUE TO PANDEMIC SITUATION(COVID-19 OR ANY OTHER)

The Traveller is required to make a note of below points relating to any pandemic outbreak during the tour

a) All related tests needed by the respective authorities (RT-PCR, Rapid Antigen Test or any other tests prescribed by concerned authorities) in India &abroad will be borne by the Traveller.

  • During travel there may be instances, wherein airlines/hotels/restaurants/suppliers/associates are unable to provide for the booked services due to various reasons which may include but are not limited to:
  • Temporary shutdown of associates/suppliers on account of pandemic emergency.
  • Traveller has shown the symptoms of Covid-19 or other infections, or aninfection test report shows positive.
  • Traveller does not follow or agree to follow the safety norms prescribed by the concerned authority/ provider.
  • The airline/cruise /rail transport service is paused/cancelled/rescheduled due to pandemic related emergency.

b) In such cases, cancellation will be as per prevailing cancellation policy. The Company would always try for minimum cancellation and provide maximum credit shell for unutilized services.

c) Please note that most of the countries require Covid-19 (RT-PCR) test within 48hrs from the date of journey. If you are travelling in our group and your Covid-19 (RT-PCR) report comes positive, in such cases the cancellation charges will be 100% of the total package cost and there will be no refund / adjustments against your payment.

17. FORCE MAJEURE - UNAVOIDABLE

The Company shall be excused from the performance or punctual performanceof any of terms and conditions/services/tour or part thereof as above, if theperformance thereof is prevented or delayed by any cause beyond the reasonable control of the company, which shall include acts of God, riots, wars,accidents, embargo, terror attacks, coup strike, natural calamities or acts of government, or delays/negligence/carelessness in the performance ofthe independent contractors caused by any such circumstances as referredhere. Any additional cost incurred by the Company, for the services provided tothe Traveller, during the Force Majeure event, shall be paid by the Traveller. As a result of any Force Majeure events, we may be forced to make alterations to our tour itinerary, which are covered in section 3.
